A Reference Plan is a crucial legal document that accurately defines portions of a property for specific legal or development purposes. Unlike a broader property report, a Reference Plan acts as a surgical tool for land administration, providing the exact geometric and mathematical framework required to divide or deal with specific parcels of land within the Ontario land registry system.
Reference Plans are typically requested when a property owner or developer needs to alter the current legal status of their land. You will likely encounter the need for a Reference Plan in the following scenarios:
Dividing a larger piece of property into smaller, independent parcels often requires a new Reference Plan to formally register the new boundaries with the Land Registry Office.
If you are granting an easement to a utility company or a neighbor, a Reference Plan is essential to legally define the specific area subject to that access right.
Financial institutions may request a Reference Plan to clearly define the security interest in a specific portion of a larger land holding.
For long-term commercial leases involving a specific part of a lot, a Reference Plan ensures the area of the lease is described with absolute legal certainty.
Once prepared by our OLS team, a Reference Plan must be deposited or registered with the Land Registry Office. Upon registration, it receives a plan number (e.g., 62R-XXXXX), which then becomes the legal reference for all future documents affecting those specific parcels of land.
Because Reference Plans are permanently integrated into the Ontario land registry, they must be flawless. Any mathematical error or misinterpretation of site conditions can lead to years of legal complexity, especially when dealing with land ownership and title transfer. At Lejan Land Surveying, our process involves exhaustive site analysis, precise field measurements, and careful interpretation of historical survey records to produce plans that meet the rigorous standards of the Ministry of Government and Consumer Services.
Our experienced surveyors understand the local municipal requirements across the GTA.
